Structural Defects - Code Violations

"Liberty Homes, Inc. is one of the nation's leaders in the manufactured housing industry.  With over 60 years of experience building modular homes, we are dedicated to providing quality, affordable modular housing.  When purchasing a Liberty home, the commitment from the Liberty Homes' family to customer satisfaction is there for you.  And we'll be around to honor that commitment in the years to come.  You can depend on it! Together we can make your dream home a Liberty Home." (as noted on the Liberty Homes, Inc website)

Liberty Homes, Inc, from the beginning, had refused to replace these two modular sections, even though the dealer and his hired set crew said they have never seen anything this bad.  After Liberty's guys re-set the "home" on March 10, 2006, the two modular sections were still overhanging the foundation and were not joined together properly, and the roof peak could not be finished.  I have a Corrections Notice from the County stating that the home overhanging the foundation must be corrected (amongst other things), and that a Structural Engineer must sign off on the final repairs (i.e. the cut floor truss).  Liberty told me that they would cover up the overhanging, the gaps, etc., with OSB sheathing (up to 4.5 inches of it), and that if I want a Structural Engineer, then I would have to hire one.  When I questioned Liberty on this and on what they would do to address the Corrections Notice, the overhanging, and their not being able to joined the "home" together to finish the roof, they would not respond and ignored me, other than to say that I agreed to knowing the "home" would be like this.  When I told them that I cannot let them continue because I will get in trouble if I let them cover up the County required repairs with OSB sheathing, they bailed on me, and began telling everyone that I threw them out.  The "home" then incurred severe water damage because Liberty's guys never secured the roof peak from potential adverse weather conditions.  Finally, Liberty Homes, Inc VOIDED THE WARRANTY, stating that I neglected the home, even though I never worked on the "home" and the Liberty guys were the last ones to do any work.

Above is a slideshow of some sample photos of the modular home that Liberty Homes, Inc. built, and delivered; this modular home was originally built for Indiana, and not Illinois.  This home was sold by Robb Robbins of Woodale Homes, Inc of Oregon, IL (filed for BANKRUPTCY as a direct result of my suing him); this modular home was not approved for sale in IL until months after the sale, which is against the law.  This modular home was built with serious code violations (see PHOTOS), which is against the law.

In the photos above... The two modular sections were delivered on January 13, 2006 (a rainy day); they arrived with a window open, and a patio door open.  I paid extra to have the home wrapped in additional protective plastic, and it arrived with the plastic hanging on its side and a large hole torn in the side.  Robb Robbins, the dealer, signed off on an inspection sheet, even though he never examined either modular section inside.  There is a cut floor truss to allow a drain line AND ductwork to go through.  Keep in mind that this home was inspected and approved at the Liberty Homes plant.  Water was noted pouring from this wet moldy insulation on set day.  This should be a nice 1500sq.ft. home.  Horrendous cracks appeared in the drywall after the dealer's set crew attempted to set the home on January 14, 2006.  Here are more drain lines going through ductwork, a hole bored in a floor truss to put a drain line through (but it stops before the bottom of the floor truss), plus another drain line cut on an angle which is again going thru ductwork, plus broken water lines, moldy insulation, and then water lines that actually go thru ductwork.  NTA, Inc of Nappenee, Indiana ceritified that this modular home was inspected and built to code.

As a direct result of my situation, IL State Representative Mike Tryon (64th District), and IL Senator Pamela J. Althoff sponsored House Bill 1142.  This Bill passed the IL House and IL Senate with a near unanimous decision (1 Rep did not vote).

The Liberty Homes, Inc headquarters is located in Goshen, Indiana.  They manufacture modular and mobile homes.
